Terms of Service

  1. Terms

    1. BitRewriter is operated by Foldstone Ltd., a limited company, registered in Ireland.
    2. By accessing the websites at https://bitrewriter.com or any other websites owned or operated by Foldstone Ltd for use by the BitRewriter service, you are agreeing to be bound by these terms of service, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the BitRewriter websites. The materials contained in the BitRewriter websites are protected by applicable copyright and trademark law.

  2. Disclaimer

    1. The materials on Foldstone Ltd's BitRewriter websites are provided on an 'as is' basis. Foldstone Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
    2. Further, Foldstone Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its websites or otherwise relating to such materials or on any sites linked to the BitRewriter websites.

  3. Limitations

    1. In no event shall Foldstone Ltd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on BitRewriter websites, or the content generated by the BitRewriter websites, even if Foldstone Ltd or a Foldstone Ltd authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

  4. Permitted use

    1. You are not permitted to use the BitRewriter websites for other than the following purposes:
      1. Transform or translate data using only expressly documented functionality.
    2. Any excessive use of the BitRewriter websites that negatively impacts the ability of other users to use the BitRewriter websites effectively, or that negatively impacts the operation or administration of the websites, may be restricted in any way we deem appropriate.
    3. You are free to use any content generated for any purpose, commercial or otherwise, once you have legal rights to the data you provide to our service, and once such content does not violate any of these terms and conditions or any applicable laws and regulations, and once it is created with an active subscription in compliance with terms and conditions applicable to the generated content.
    4. By using any generated content from the BitRewriter service, you agree that no content will be used without you first ensuring that the content is correct and suitable for use. You agree to be solely responsible for all content generated by you as well as through your subscription, and to accept all liability for such content.

  5. Content restrictions

    1. If Foldstone Ltd becomes aware of illegal or prohibited content on the BitRewriter websites, or content that does not have the consent of the respective rightsholders, or if you use the BitRewriter websites to create or distribute illegal, or prohibited content, or content without the permission of rightholders, Foldstone Ltd may delete or block such content and/or suspend your access to our services, without refund.

  6. Accuracy of materials

    1. The materials appearing on Foldstone Ltd's BitRewriter websites could include technical, typographical, or photographic errors. Foldstone Ltd does not warrant that any of the materials on its websites are accurate, complete or current. Foldstone Ltd may make changes to the materials contained on its websites at any time without notice. However, Foldstone Ltd does not make any commitment to update the materials.

  7. Links

    1. Foldstone Ltd has not reviewed all the sites linked from its websites and is not responsible for the contents of any such linked sites. The inclusion of any link does not imply endorsement by Foldstone Ltd of the site. Use of any such linked site is at your own risk.

  8. Subscriptions

    1. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a subscription.
    2. At the end of each Billing Cycle, your subscription will automatically renew unless you cancel it, or we cancel it. You may cancel your subscription renewal either through your online account management page or by contacting our customer support team.
    3. You may cancel your subscription at any time. A subscription cancelled by you will remain available to use until the end of the billing period active at time of cancellation.
    4. If there is a change in price of your subscription, the BitRewriter websites will be updated with details of the upcoming changes at least 30-days in advance of the change. Price changes are only applicable to any individual subscription, on renewal, at the end of the billing period during which the price change became active.
    5. A valid and supported payment method, such as credit card, is required to process the payment for your subscription. You shall provide our payment provider with accurate and complete billing information such as full name, address, state, zip code, telephone number, and any other necessary valid payment information. By submitting such payment information, you authorize our payment provider to charge all subscription fees incurred through your account to any such payment instruments.
    6. We do not process payments directly ourselves. Instead, we rely on third party services to provide payment processing services as a merchant of record. We reserve the right to change the services we use to manage payments without notice.

  9. Refunds

    1. We offer a money-back guarantee on all subscriptions. For monthly subscriptions, we offer refunds of advance payments made for the most recent billing period. For annual subscriptions, we offer pro rata refunds for the unused portion of your annual subscription. If you're not satisfied with your purchase, contact us at customer_billing@bitrewriter.com, and we'll process your request.
    2. We reserve the right to challenge abuse of the above guarantee, where a customer repeatedly claims, for multiple refunds.
    3. Refunded subscriptions will be deactivated at the time of refund.

  10. Modifications

    1. Foldstone Ltd may revise these terms of service for the BitRewriter websites at any time without notice. By using the BitRewriter websites you are agreeing to be bound by the version of the terms of service that is active at the time of use.

  11. Governing Law

    1. These terms and conditions are governed by and construed in accordance with the laws of Ireland and you irrevocably submit to the exclusive jurisdiction of the courts of that country.
